A hearing on the Chapter 7 Trustee's Motion to Approve Compromise and Settlement with Gould & Burke, PLLC, Michael Gould and Michael Burke "("G&B") Prior to Litigation will be heard on November 14, 2011 at 9:00 a.m. at the United States Bankruptcy Court for the District of New Hampshire, 1000 Elm Street, 11th Floor, Courtroom 2, Manchester, New Hampshire. If the Motion is approved then, $400,000.00 of $2,000,000.00 in available insurance coverage for legal malpractice will be paid to the bankruptcy estate of CLM and the remaining $1,600,000.00 will be made available to other claimholders against G&B through a non-bankruptcy mediation process set up by G&B's insurer. Failure to participate in the mediation process could result in a lack of insurance or assets to pay an independent claim against G&B. Objections to the motion, if any, must be filed on or before November 7, 2011. The mediation is scheduled for December 12 and 13, 2011 at 9:00 a.m. at the law offices of Upton & Hatfield, LLP, 10 Centre Street, Concord, NH. For further information please contact counsel for G&B, Phil McLaughlin, Esquire of McLaughlin Law Office, P.C., 501 Union Avenue, Suite 2, Laconia, NH 03246. Phone: (603) 528-6953; Fax: 528-6955.
